TERMS AND CONDITIONS

1. BIKE RENTAL POLICIES

The customer hereby rents bicycles from Bikestardo Sunshine Cycling Spain SL. (hereinafter referred to as Bikestardo) subject to all terms and conditions of this agreement:

 

1.1. Bikestardo rents out bicycles with prior booking. Urgent bookings for rentals on the same day can be agreed with Bikestardo. At the end of the rental period the customer must return the bicycles to Bikestardo. The daily rental period is from 9.00 to 19.00.

 

1.2. If the customer fails to return the rented items to Bikestardo within the agreed rental period, even for reasons beyond his/her control, Bikestardo shall be entitled to demand compensation.

 

1.3. The rented items will be delivered and picked up on time and date according to the previous booking. The customer has to give clear information about the meeting point and place to deliver and pick up the rented items and provide a functional mobile number. The customer must make sure he receives and returns all the rented items upon delivery. If the customer needs extra / different equipment after the delivery has already taken place an additional fee will be charged.

 

1.4. Any changes of the rental contract must be notified by the customer and confirmed by Bikestardo. Any delays on delivery / pick up of the rented items will result in an additional charge of 10€ per 15 minutes commenced.

 

1.5. Exceptional circumstances or force majeure could lead to delay of delivery/pick up of the rented items. In such cases Bikestardo will always notify the customer about the changes.

 

1.6. All rented items are presented in perfect working order set up by professional mechanics. Bikestardo accept general wear and tear during the rental period, however any bicycle/equipment returned with excessive cleaning requirement will result in a 20€ charge to the customer. Bikestardo accept small scratches due to normal usage, however deep scratches in the bike frame or components are not considered normal wear and tear and the customer will be charged accordingly. Any bike returned with a flat tire will be charged 20€. If the customer has used the spare tube provided they will be charged 5€.

 

1.7. The rented items should only be used by the designated customer and the members of his/her party. The customer who pays for the rental is responsible for his/her party and will share all necessary information with them. The customer accepts to use the rented bicycle/equipment with all due care and correctness to observe road safety regulations. Customers are forbidden to use the rented bicycle under the influence of alcohol or drugs. Customers are not allowed to modify or alter the rented item in any way. Customers are not allowed to attach bags to the frame.

 

1.8. The customer is obliged to take good care of the rented equipment and to protect it from damage, loss and theft. The customer can not leave the bike out of sight and must store the bike inside their accommodation. In case of damage, loss or theft of the bicycles, components or any of its parts, the customer has to contact Bikestardo right away. Bikestardo will charge the customer the full cost of the damages, missing or broken items at market prices. 

2. RESERVATION, PAYMENT, DEPOSIT, DELIVERY

 

2.1. Reservation
Bike reservations must be done online prior to the rental period. If the customer urgently needs a bicycle reservation can be made over email. When making the reservation online or over email the customer must read and accept the terms and conditions.

 

2.2. Payment
The customer must pay the full amount for the rented items prior to the rental period. The reservation is confirmed when Bikestardo confirms receipt of the payment via e-mail. Payment is done online using credit card. 

 

2.3. Deposit
On delivery of the bicycle the customer will be asked for passport details along with a credit card deposit for each bicycle. The deposit is 400€ for each Di2 bike and 200€ for all other bikes. The customer renting a bike must be over 18 years old. The deposit is only a reservation and will automatically be released after 30 days if the rented equipment is returned in good condition. At the end of the rental period, the customer accepts the charges for any damages, missing or broken items at market prices. If the damages, missing or broken items exceed the deposit amount, the customer must settle the balance. 

 

2.4. Delivery

Delivery is free to La Cala de Mijas. For other areas the price for delivery and pick up is 1€ per km from La Cala de Mijas. You have to add the delivery area under step 2 before you check out. If you forget to add the delivery area when you book online you will have to pay the delivery fee when the bike is delivered.

 

3. RESPONSIBILITY OF CUSTOMER

3.1. The customer accepts the charges for any damages, missing or broken items at market prices at the end of the rental period agreed in the contract. If the damages, missing or broken rented items exceed the deposit amount, Bikestardo will charge the balance from the customers credit card used for the initial online booking.

 

3.2. Bikestardo does not provide a refund for cancellations or early return of rented items. Bikestardo can not be made responsible for the customer's personal circumstances, sicknesses, weather conditions or any other event of force

majeure. Customer accepts that no refunds would be made for any of the above reasons without any exceptions.

 

3.3. The customer is obliged to make provision for the protection of the rented items, as well as the protection from loss and theft. In case of theft or loss during the rental period, customer has to bear all the costs for the reconditioning at market prices. From the moment of signing the contract and receiving a rented item, the customer is fully responsible for the rented items.

3.4. In case of theft or loss of the rented bicycles/equipment, Bikestardo applies a charge to the customers credit card of minimum: 5000€ per FELT FR Advanced 105 Di2 road bike. 3000€ per FELT FR Advanced 105 and VR performance 105 road bike. 3700€ per Megamo Raise 15 SH12 road bike. 2500€ per Megamo West 10 gravel bike. 2800€ per Megamo Ridon Electric Mountain Bike. 1800€ per Megamo Factory 30 Mountain Bike. 600€ per Kids Mountain Bike. If the rented item is found after it was stolen, Bikestardo will contact the customer.

 

3.5. Bikestardo recommends customers to sign a travel insurance that covers rented items against loss, theft and damage. In case of loss, theft or damage, Bikestardo will do the best and cooperate with clients insurance.

4. ISSUES WITH RENTED ITEMS DURING THE RENTAL PERIOD

 

4.1. Small fixes on rented items such as punctures and basic maintenance are the customer's responsibility. Regarding all other repairs on rented items during the rental period, the customer must contact Bikestardo as soon as possible and agree on the service charges.

 

4.2. If the issue is caused by a faulty part on the bicycle/equipment, Bikestardo takes full responsibility and will repair/replace the bicycle without extra cost.

 

4.3. If the issue with the bike is caused by the customer due to a crash or lack of mechanics knowledge, the customer takes full responsibility and must pay for the repair/support needed.

 

4.4. When the customer has agreed to the service charges Bikestardo will meet the customer at the agreed meeting point and repair/replace the bicycle/equipment. Bikestardo do not accept repair costs made by other mechanics unless this has been agreed on prior to the repairs.

5. LIMITATION OF LIABILITY

 

5.1. Bikestardo has third party liability insurance coverage of the bicycle rental activity. Bikestardo is not responsible for injury or damages caused to/by the client during the rental period.

 

5.2. The customer is responsible for sufficient personal insurance coverage for risks that may occur during the rental period. Bikestardo is not liable for any claims for body injury or harm, accidents or loss of personal belonging caused by weather, sickness, persons, cars or any other causes and causers. 

 

5.3. The customer must respect Spanish traffic regulations. The customer is responsible for any ticket or fine due to incorrect use of the bicycle.

5.5. The provisions of this contract shall be governed by Spanish law. For all disputes derived from this contract or relating to it, the jurisdiction shall be Fuengirola, Spain.
