Terms and conditions


1. BIKE RENTAL POLICIES

The customer hereby rents bicycles from Bikestardo subject to all terms and conditions of this agreement:

1.1. Bikestardo rents bikes only with prior booking. Overnight rentals can be agreed with Bikestardo. At the end of the rental period the customer must return the bicycles to Bikestardo. The daily rental period is from 9 am to 21 pm.

1.2. If the customer fails to return the rented items to Bikestardo within the agreed rental period, even for reasons beyond his/her control, Bikestardo shall be entitled to demand compensation.

1.3. The rented items will be delivered and picked up on time and date according to the previous booking. The customer has to give clear information about the meeting point and place to deliver and pick up the rented items and provide a functional mobile number.

1.4. Any changes of the rental contract must be notified by the customer and confirmed by Bikestardo. Any delays on delivery / pick up of the rented items will result in an additional charge to the customer.

1.5. Exceptional circumstances or force majeure could lead to delay of delivery/pick up of the rented items. In such cases Bikestardo will always notify the customer about the changes.

1.6. All rented items are presented in perfect working order set up by professional mechanics. Bikestardo accept general wear and tear during the rental period, however any bicycle/equipment returned with excessive cleaning requirement will result in a 10€ charge to the customer.

1.7. The rented items should only be used by the designated customer and the members of his/her party as mentioned in the rental contract. The customer accepts to use the rented bicycle/equipment with all due care and correctness to observe road safety regulations. Customers are forbidden to use rented bicycle under the influence of alcohol or drugs. Customers are not allowed to modify or alter the rented item in any way. 

1.8. The customer is obliged to take good care of the rented equipment and to protect it from damage, loss or theft. In case of damage, loss or theft of the bicycles, components or any of its parts, Bikestardo will charge the customer the full cost of the missing or broken items at market prices.

 

2. RESERVATION, PAYMENT, DEPOSIT, DELIVERY

2.1. Reservation
Bike reservations must be done online prior to the rental period in order for Bikestardo to confirm availability. If the customer urgently needs a bike on the same day reservation can be made over the phone.

2.2. Payment
The customer must pay the full amount for the rented items prior to the rental period. The reservation is confirmed when Bikestardo confirms receipt of the payment via e-mail. Payment is done online using credit card. Urgent rentals can be paid with credit card or cash when bike is delivered. 

2.3. Deposit
On delivery of the rented items the customer must read, accept and sign the rental agreement. The customer will be asked for passport details along with a 200€ deposit for each bike, which can be paid by credit card. The Customer signing the rental contract must be over 18 years old. At the end of the rental period, the customer accepts the charges for any missing or broken items at market prices, which will be invoiced to the customer. The deposit will be refunded if the rented equipment is returned in the same conditions it was procured. If the missing or broken items exceed the deposit amount, the customer must settle the balance. 

2.4. Delivery
Delivery is free to Fuengirola and Mijas Costa. For other areas the price for delivery and pick up is 1€ pr. km. from La Cala de Mijas. Delivery fee will be added to the total amount when booking online. Choose the area/city in the dropdown menu where you want the bike to be delivered to.

 

3. RESPONSIBILITY OF CUSTOMER

3.1. The customer accepts the charges for any missing or broken items at market prices at the end of the rental period agreed in the contract. If the missing or broken rented items exceed the deposit amount, the customer must settle the balance.

3.2. Bikestardo offers a bike insurance that covers repair expenses up to 300€ pr. bike. If the repair expenses exceed this amount the customer must settle the balance.

3.3. Cancellations made 14 days or more before the rental period will be charged 5% of the total prepaid amount. Cancellations made later than 14 working days before the rental period will be charged the full amount of the prepaid bicycles/equipment. No shows would be charged in full, and considered non‐refundable. Exceptions to this policy cannot be made for any reason.

3.4. Bikestardo do not provide a refund for early return of rented items. Bikestardo cannot be made responsible for the customer's personal circumstances, sicknesses, weather conditions or any other event of force majeure. Customer accepts that no refunds would be made for any of the above reasons without any exceptions.

3.5. The customer is obliged to make provision for the protection of the rented items, as well as the protection from loss and theft. In case of theft or loss during the rental period, customer has to bear all the costs for the reconditioning at market prices. From the moment of signing the contract and receiving a rented item, the customer is fully responsible for the rented items.

3.6. In case of theft or loss of the rented bicycles/equipment, Bikestardo applies a charge of minimum: 1800€ per TCR Advanced Road Bike and Fathom Mountain Bike. 2600 Euro per Defy Road Bike, Trance Mountain Bike and Fathom E+ Power Mountain Bike. 4400€ per VR Ultegra Di2 Road Bike. 3300€ per VR Ultegra Road Bike. 2400€ per VR Ultegra 105 Road Bike. 1700€ per Breed Gravel Bike. 3000€ per Edict Mountain Bike. 1900€ per Doctrine Mountain Bike. 1200€ per Fat Bike and 600€ per Kids Mountain Bike.

3.7. If the rented item is found after it was stolen, Bikestardo will contact the customer.

3.8. Bikestardo recommends customers to sign a Travel Insurance that covers rented items against loss, theft & damages. In case of theft or damage, Bikestardo will do the best and cooperate with clients insurance.

 

4. ISSUES WITH RENTED ITEMS DURING THE RENTAL PERIOD

4.1. Small reparations on rented items such as punctures are the customer's responsibility. Regarding all other repairs on rented items during the rental period, the customer must contact Bikestardo as soon as possible and agree on the service charges.

4.2. If the issue is caused by a faulty part on the bicycle/equipment, Bikestardo takes full responsibility and will repair/replace the bicycle without extra cost.

4.3. If the issue with the bike is caused by the customer due to a crash or lack of mechanics knowledge, the customer takes full responsibility and must pay for the repair/support needed.

4.4. When the customer has agreed to the service charges Bikestardo will meet the customer at the agreed meeting point and repair/replace the bicycle/equipment. Bikestardo do not accept repair costs made by other mechanics unless this has been agreed on prior to the repairs.

 

5. LIMITATION OF LIABILITY

5.1. Bikestardo has third party liability insurance coverage of the bicycle rental activity. Bikestardo is not responsible for injury or damages caused to/by the client during the rental period.

5.2. The customer is responsible for sufficient personal insurance coverage for risks that may occur during the rental period. Bikestardo is not liable for any claims for body injury or harm, accidents or loss of personal belonging caused by weather, sickness, persons, cars or any other causes and causers. 

5.3. The customer must respect Spanish traffic regulations. Any ticket or fine due to incorrect use of the bicycle will be completely assumed by the customer.

5.5. The provisions of this contract shall be governed by Spanish law. For all disputes derived from this contract or relating to it, the jurisdiction shall be Mijas, Spain.
